Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, applications, and services offered by Tess7 LLC (“Tess7,” “we,” “us,” or “our”), including recruiting, staffing, job posting, application, and Job Security subscription features (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the minimum age required to enter into a binding contract and seek employment in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement and that all information you provide is accurate and current.

2. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must promptly notify us of any unauthorized access or suspected breach of your account.
  • We may suspend or terminate accounts that contain false information, violate these Terms, or create security or legal risk.
  • Account types include candidates/employees, employers, and Job Shield clients. You must register under the account type that accurately reflects how you use the Services.

3. Description of Services

Tess7 provides an online platform that helps employers post jobs, review applicants, and manage hiring activity, and helps candidates discover opportunities, submit applications, upload documents, and track application status. Tess7 also offers optional Job Security and related subscription plans.

Tess7 is not the employer of candidates unless expressly stated in a separate written agreement. We do not guarantee interviews, job offers, placements, hiring outcomes, or subscription benefits in every circumstance. The Services are a platform and business support tool, not a promise of employment or income.

4. Candidate and Employee Responsibilities

If you use the Services as a candidate or employee, you agree to:

  • provide truthful, accurate, and lawful resume, profile, and application information;
  • upload only documents you have the right to share;
  • apply only for positions you are genuinely interested in and qualified to pursue;
  • not misrepresent your identity, work authorization, credentials, or experience;
  • comply with applicable employment, immigration, and anti-discrimination laws.

5. Employer Responsibilities

If you use the Services as an employer, you agree to:

  • post only legitimate job opportunities for which you are authorized to hire;
  • provide accurate job descriptions, compensation information, and company details;
  • review and handle applicant data lawfully and only for legitimate hiring purposes;
  • comply with all applicable employment, labor, equal opportunity, wage, privacy, and background-check laws;
  • not use applicant information for unlawful discrimination, spam, resale, or unrelated marketing.

Employers are solely responsible for hiring decisions, interview conduct, offer terms, onboarding, and workplace compliance.

6. Job Listings, Applications, and Communications

  • Employers control job postings and may edit, close, or remove listings.
  • Submitting an application does not create an employment relationship with Tess7 or guarantee review by an employer.
  • We may remove content or accounts that are fraudulent, misleading, offensive, unlawful, or harmful to users or the platform.
  • We are not responsible for communications, representations, or agreements made directly between employers and candidates outside the scope we expressly provide.

7. Job Security and Subscription Plans

If you purchase or enroll in a Job Security or related subscription plan:

  • fees, billing intervals, and plan features are described at the time of purchase or on the applicable plan page;
  • subscriptions renew according to the selected billing cycle unless canceled as provided at purchase or by contacting us;
  • benefits, stipends, reimbursements, or protection features are subject to plan terms, eligibility requirements, verification, and applicable law;
  • subscription benefits are not insurance unless expressly identified as such in a separate written policy or certificate;
  • failure to pay fees may result in suspension or termination of subscription access.

Except where required by law, fees already paid are non-refundable once the applicable billing period has begun, unless we state otherwise in writing.

8. Acceptable Use

You may not:

  • use the Services for unlawful, fraudulent, harassing, or deceptive purposes;
  • scrape, crawl, copy, or harvest data from the Services without our written permission;
  • attempt to gain unauthorized access to accounts, systems, or data;
  • upload malware, interfere with site operation, or bypass security controls;
  • infringe intellectual property, privacy, or publicity rights;
  • post content that is defamatory, discriminatory, obscene, or otherwise objectionable;
  • use the Services to send unsolicited commercial messages or spam.

9. Intellectual Property

The Services, including the Tess7 name, logo, website design, software, text, graphics, and other content provided by us, are owned by Tess7 or our licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to access and use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from our proprietary materials except as expressly permitted.

You retain ownership of content you submit, but you grant Tess7 a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use that content as needed to operate, promote, and improve the Services.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Equal Employment Opportunity

Tess7 supports equal employment opportunity. Employers using the platform must comply with applicable federal, state, and local anti-discrimination laws, including laws prohibiting discrimination based on race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, veteran status, or other protected characteristics.

12. Background Checks and Screening

Some employers may conduct background checks or other screening after an application is submitted. If an employer uses consumer reports or background screening, the employer is responsible for complying with the Fair Credit Reporting Act and related notice and consent requirements. Tess7 does not control employer screening practices unless expressly stated otherwise in writing.

13. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESS7 DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESS7 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TESS7 FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Tess7 and its officers, directors, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your content, your hiring or application activity, your violation of these Terms, or your violation of any law or third-party rights.

16. Suspension and Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you violated these Terms, created risk for us or other users, or if required by law. You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of Alabama, without regard to conflict-of-law principles, except where federal law applies. Any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Alabama, and you consent to their jurisdiction, unless applicable law requires a different venue.

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.

18. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Last updated” date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
